Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Gotya website, applications, and services (together, the “Service”), operated by MAVELLI - FZCO, a Free Zone Company (FZCO) registered in IFZA Dubai, Dubai Silicon Oasis, Dubai, United Arab Emirates (License No. 28607) (“Gotya”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You may not use the Service where it is prohibited by applicable law. By using the Service you confirm that you meet these requirements.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorised use. We may suspend or close accounts that violate these Terms or that we reasonably believe are involved in fraud, abuse, or unlawful activity.

3. The Service

Gotya offers digital “packs” that each contain one authentic, professionally graded collectible held in a secured, insured vault. Ownership of a collectible is recorded in our systems; transferring ownership does not move the physical item, which remains in the vault until redeemed for shipment. The Service also includes a marketplace, an instant buyback option, a loyalty programme, and a physical redemption process.

4. Packs, odds and chance

Each pack contains exactly one collectible drawn from a finite, vaulted inventory. The probability of receiving collectibles in each value bracket is published and updates in real time as inventory changes. Outcomes are determined by chance. The amount you pay for a pack is not a guarantee of the value of the collectible you receive; some pulls are worth less than the pack price and a minority are worth more. Please play responsibly and within your means. You can set spending limits or self-exclude in your account settings.

5. Wallet, payments and fees

You may fund your Gotya wallet using the payment methods we make available, including card payments processed by our payment provider (Stripe). Card payments may incur a processing surcharge, which is shown before you confirm. Marketplace listings currently carry a 0% seller fee. Each purchase may include an asset-management fee for storage, listing, and logistics. Auction purchases include a buyer’s premium as displayed. Wallet balances are denominated in US dollars and are not bank deposits and do not earn interest.

6. Instant buyback

We may offer to repurchase eligible collectibles at a percentage of their estimated fair-market value, as shown at the time of the offer. Buyback offers are time-limited, optional, and funded from our working capital. Estimated values are generated by our pricing engine from secondary-market data and are estimates only, not appraisals or guarantees.

7. Redemption and shipping

You may request physical delivery of a collectible you own. Redemption requires one-time identity verification and payment of shipping, handling, and any applicable taxes or import duties, which are your responsibility. Once a collectible is redeemed it is removed from tradable inventory.

8. Prohibited conduct

You agree not to: use the Service for money laundering or other unlawful purposes; manipulate prices or engage in wash trading; use bots or automated means to gain an unfair advantage; attempt to interfere with the integrity or security of the Service; or infringe the rights of others.

9. Intellectual property

The Service, including its software, design, and trademarks, is owned by MAVELLI - FZCO or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. Collectibles may depict third-party intellectual property owned by their respective rights holders.

10. No investment advice

Collectibles are not securities or financial instruments, and nothing on the Service is investment, financial, tax, or legal advice. Values can go down as well as up. You are solely responsible for your decisions.

11. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by law, MAVELLI - FZCO will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to the Service will not exceed the amounts you paid to us in the three months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless MAVELLI - FZCO and its officers, employees, and agents from claims arising out of your use of the Service or your breach of these Terms.

13. Suspension and termination

You may close your account at any time. We may suspend or terminate access to the Service if you breach these Terms or where required by law. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws applicable in IFZA Dubai, Dubai Silicon Oasis, Dubai, United Arab Emirates, without regard to conflict-of-law rules. Disputes will be subject to the competent courts or dispute-resolution bodies of that jurisdiction, unless mandatory consumer law provides otherwise.

15. Changes

We may update these Terms from time to time. Material changes will be notified through the Service. Your continued use after changes take effect constitutes acceptance.
